Last Updated: September 1, 2026
Welcome to Backbencher Studio. These Terms of Service explain the rules for using our website, services, digital products, templates, and applications.
By using our website or engaging our services, you agree to these Terms.
About Backbencher Studio
Backbencher Studio is a creative technology studio providing game development, Apps development, Webflow templates, Shopify apps, and digital product development services.
Our Services
Our services may include strategy, design, development, prototyping, testing, Webflow development, Shopify app development, game development, and ongoing support.
The exact scope, deliverables, timeline, and fees for a project will be defined in the applicable proposal, agreement, or statement of work.
Using Our Website
You agree to use our website lawfully and responsibly.
You must not attempt to access our systems without authorization, disrupt our services, introduce malicious software, copy our content without permission, or use our website for unlawful purposes.
Project Scope & Changes
Projects are delivered according to the agreed scope.
Requests outside the original scope—including additional pages, features, revisions, integrations, or functionality—may require additional fees and may affect the delivery timeline.
Client Responsibilities
Clients are responsible for providing accurate information, content, assets, feedback, approvals, and access required to complete a project.
Delays caused by missing materials, approvals, or access may affect the agreed timeline.
Analytics
We may use analytics and performance tools to understand how visitors interact with our website.
These tools may collect information such as pages viewed, approximate location, device information, referral sources, and interactions with our website.
We use this information primarily in aggregated or analytical form to improve our website, content, products, and services.
Payments
Project fees and payment schedules will be agreed upon before work begins.
Unless otherwise stated, work may begin after the required initial payment has been received. Additional work and third-party costs may be billed separately.
Delays & Delivery
We make reasonable efforts to meet agreed timelines, but delivery dates may change due to scope changes, delayed feedback, technical issues, third-party services, or circumstances outside our reasonable control.
Intellectual Property
Unless otherwise agreed in writing, Backbencher Studio retains ownership of its pre-existing tools, frameworks, processes, unused concepts, reusable code, and internal resources.
Upon full payment, the Client receives the rights to the final project deliverables specified in the applicable agreement.
Third-party assets remain subject to their respective licenses.
Webflow Templates
Webflow templates created by Backbencher Studio are licensed products, not transfers of ownership.
Unless a separate license says otherwise, templates may not be resold, redistributed, shared, or presented as your own original work.
Shopify Apps & Digital Products
Shopify apps, games, and other digital products may depend on third-party platforms, APIs, devices, or services.
We may update, modify, suspend, or discontinue features when reasonably necessary. We do not guarantee uninterrupted or error-free operation of every product or integration.
Third-Party Services
Our services may use or integrate with platforms such as Webflow, Shopify, hosting providers, payment processors, analytics services, APIs, and other third-party tools.
Your use of those services may be subject to their own terms and policies. We are not responsible for changes or outages caused by third-party services.
Confidentiality
We respect confidential information shared during a project and will use reasonable measures to protect it.
Additional confidentiality obligations may be established through a separate NDA or project agreement.
Portfolio & Promotion
Unless otherwise agreed in writing, Backbencher Studio may showcase completed work in its portfolio, website, case studies, presentations, social media, and marketing materials.
We will respect reasonable confidentiality requirements and may wait until a project has been publicly launched before featuring it.
Cancellation, Refunds & Liability
Project cancellation and refund terms depend on the applicable agreement and the type of service or product purchased.
Custom services may not be refundable once substantial work has been completed.
To the maximum extent permitted by law, Backbencher Studio is not liable for indirect or consequential losses resulting from the use of our services, products, or third-party platforms.
Nothing in these Terms limits rights or liabilities that cannot legally be excluded.
Changes & Contact
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date.
